Let's talk about "Default"

Default:  The failure of the respondent to appear at a hearing. The maximum fine may be assessed for default judgments as allowed by City ordinances.

Found Previously Liable?

What if I am found Previously Liable for a Building Code Violation? What does that mean?

Previously Liable: The disposition of a violation at a hearing after the respondent was found liable for that violation at a prior hearing. Typically, this disposition is used at the hearing to determine fines and penalties, and is usually followed by a finding either that the violation has been brought into compliance or that it is still not in compliance.

If you were found liable, the hearing officer is required by law to impose the penalties set forth by the Municipal Code of Chicago. If the penalty is a set fine, the hearing officer must impose that amount.

Administrative Adjudication and Administrative Record explained

Administrative Adjudication: The legal process by which an Administrative Law Judge decides whether a municipal code violation has occurred after conducting an administrative hearing.

Administrative Record: The official record of an administrative hearing. This will usually consist of the pleadings (such as notice of hearing or notice of violation often referred to as the “ticket”, the request for hearing, the motion to set-aside the default), the hearing exhibits, the testimony given under oath, and the arguments of the parties. The Administrative Law Judge is permitted to consider only the administrative record, as well as the law applicable to the case.

What is an ANOV?

ANOV stands for Administrative Notice of Violation which is a citation/ticket issued by a Chicago police officer, inspector or investigator from a City department which cites the ordinance allegedly violated. The ANOV also includes the date, time, and location of the offense, identity of person named, with details to support the allegation.

What are Strict Liability and Vicarious Liability Offenses?

What Are My Rights at a Hearing?

You have the right to represent yourself or hire an attorney to represent you at your own expense. And, you have the right to tell your side of the story to the hearing officer.

If the city presents its case through the in-person testimony of a city official or other witness, you have the right to ask questions of the city's witness.

If the city presents its case through the sworn affidavit testimony you may have the right to request that the city official attend the hearing so that you may ask questions of that city witness.  However, federal and state case law may not require the physical attendance of that city official at the hearing. The decision on whether or not to grant a subpoena request is up to the individual hearing officer.

Who May Participate in a Building Code Violation Hearing?

Each hearing will have a hearing officer. The hearing officer is a licensed Illinois attorney who presides over the hearing as an independent and impartial "judge."

The city, as the petitioner, may have their attorney there to present its case and, may also bring witnesses to support its case.

You may represent yourself, but it is recommended that you hire an attorney to represent you.

Other respondents may also be present in the hearing room waiting for their case to be called. Because the hearing itself is open to the public, community groups, court advocates or other interested members of the public may be present in the hearing room to observe the proceedings.

Found Liable or Not Found Liable

What If I Am Found Liable for a Building Code Violation?

If you are found liable, the hearing officer is required by law to impose the penalties set forth by the Municipal Code of Chicago. If the penalty is a set fine, the hearing officer must impose that amount. If the penalty has a minimum and maximum fine range, the hearing officer must impose a fine in that range. A hearing officer does not have the legal authority to waive a fine. Penalties may also include: paying restitution (the costs to undo the damage caused by the violation) and/or administrative costs.

If you are found not liable, the hearing officer will dismiss the case against you and will not impose any penalties.

How is an Administrative Hearing conducted?

Administrative Hearings while less formal than a state court trial, still follows a basic structure to ensure fairness and due process of law. All testimony is under oath and recorded.

The hearing officer begins by giving opening remarks outlining the hearing process. Since the city initiated the case against you it has to present its evidence before you present a defense. To present its case, the city may: introduce the sworn Notice of Violation of the police officer or city inspector; call witnesses; or offer other evidence such as photographs or other documents.

The city is required to establish what is called a "prima facie case." That simply means that it must set forth the necessary allegations that a code violation may have occurred. The hearing officer reviews the city's case to see if it has alleged all the necessary elements required by law. If the city has not properly alleged its case, the case will be dismissed. If the city has properly alleged a case, the hearing will proceed and you will have the opportunity to present your case.

To present your case, you may, like the city: introduce a sworn affidavit; testify; call witnesses; or offer other evidence such as photographs, receipts or other documents. After both sides have had an opportunity to present their case, the hearing officer will render a decision and written order. The city's burden of proof in these matters is "by a preponderance of the evidence," which means that taking everything into consideration, the hearing officer must believe that "it is more likely than not" that a code violation has occurred.

What happens if you do not comply with a hearing officer's order?

A hearing officer's order can be enforced in the same manner as a Judge's order in that it can be used to place a lien on your property, garnish your wages and/or affect your credit. The city may also file a criminal or quasi-criminal action in state court where a Judge could impose additional penalties and jail time.

What Can I Do About a Default Judgment?

A "Default Judgment" is similar to a Judge's order in that it can be used to place a lien on your property, garnish your wages and/or affect your credit. The city usually requests that the maximum fine be imposed in default matters. If you:
  1. missed your hearing date for a good reason; 
  2. have good reason to believe that the Notice went to the wrong address; or 
  3. believe that the city cited the wrong person, business or property, 
You may file a written Motion to Set-Aside a Default Judgment with the Department of Administrative Hearings. In general, your Motion must be filed within 21 days of the mailing date stamped on top of the default judgment order. Motions are not granted automatically. You must file your motion on time and you must provide good reason why you did not respond to the Notice of Violation.  A motion form may be obtained from and filed in person Monday through Friday, 9:00 a.m. to 4:00 p.m. at the Main Information Desk, 400 West Superior Street location only.

If you ignore the Building Code Violation Notice, a hearing officer may enter a Default Judgment against you based on the evidence presented. What is an Administrative Law Judge?

Administrative Law Judge (“ALJ”):
This is the person who conducts an Administrative Hearing. They decide whether a municipal code violation has occurred and, if so, what penalty should be imposed. The City of Chicago, Department of Administrative Hearings contracts with approximately 74 Administrative Law Judges to conduct hearings. Administrative Law Judges are private attorneys who have been licensed to practice law in the State of Illinois for a minimum of 3 years.

REMINDER about door and window screens

On July 18, 2014, after incidents this summer in which young children were severely injured or killed after falling from an open window, the Department of Buildings and the Department of Public Health are reminding residential building owners, occupants and parents to install operable window guards on windows and limit window openings to 4 inches or less.

The Chicago Building Code requires every door opening and every window to have screens in place from April 15th to November 15th of each year. Specifically, every door opening directly from any family unit to the outdoors and every window, or other outside openings used for ventilation purposes, must be supplied with a screen of not less than 16 mesh per inch and every screen door shall have a self-closing device in good working condition.

In 2014, as of July 18, 2014, the Department of Buildings issued 168 violations related to screens in windows.  Further information can be found on the City of Chicago website. If you own property in Chicago, make sure you keep current with the maintenance of your property. Owners are required by law to make necessary repairs and maintain their property in a safe condition. Environmental Permits & Regulation

The City of Chicago Department of Public Health's Environmental Permitting and Inspection Program aims to protect public health and the environment by reducing environmental risks throughout the city.  Staff in this program respond to citizen complaints, inspect sites and facilities, and enforce the environmental ordinances in the Chicago Municipal Code.

This program also includes a comprehensive permitting section.  Approximately 8,000 permits are issued each year for operations and activities that have an impact on the environment.  For example, permits are issued for work involving above ground and underground storage tanks, recycling facilities, waste handling facilities, construction site rock crushers, sandblasting, grinding, chemical washing, and the installation and operation of any equipment that has the potential to create or control air pollution.

Home Owner Assistance Permit

Did you know that the City of Chicago offers assistance in regards to permits for homeowners? The Home Owner Assistance permit process allows the owner occupant of a single family home to prepare the architectural drawings for a home alteration or addition with the assistance of a Department of Buildings Project Manager. No architect is required.

The Project Manager will perform the zoning review and assist in the preparation of a simple set of code compliant permit drawings.  Complex zoning issues, however, may require a Zoning Ordinance Administration review in Room 905 of City Hall.  The Home Owner Assistance process typically requires 3 to 5 one hour meetings with the Project Manager at any of  their three Neighborhood Residential Permit Centers.  The owner occupant must personally attend and participate in all meetings.

If you are caught without a permit, you may receive a costly Building Code Violation. The City of Chicago can also review your buildings past history and cite you for something that happened 10 years ago in which you did not obtain a permit.

Life Safety and High Rise Buildings

The City of Chicago’s High Rise Sprinkler and Life Safety Evaluation (LSE) Ordinances better protect the lives of residents, employees and visitors. The purpose is to demonstrate that a specific high-rise building can provide a reasonable level of safety from fire for the occupants. Safety Evaluations are intended to satisfy the Chicago Building Code  for an existing building exceeding 80 feet in height which does not have a full sprinkler system and is either occupied for non-transient residential uses or which is a landmark or other building so designated in accordance with the ordinance.

The Sprinkler Installation Ordinance (13-169-205) requires all pre-1975 commercial high rise buildings that are not land marked to install a full sprinkler system by January 1, 2017.  This ordinance also exempts existing pre-1975 non-transient, residential high rise buildings from the requirement to fully sprinkler the building.

The High Rise Life Safety Evaluation Ordinance (13-196-206) requires that the high-rise commercial buildings and residential buildings exempted from retro-fitting with sprinklers must undergo a rigorous evaluation of the building’s life and fire safety features from an Illinois Licensed Design Professional. The Design Professional must then submit a Life Safety Evaluation Report to the Department of Buildings and the Chicago Fire Department for their review and approval.  This report will score the Building in 18 categories of Life and Fire Safety and must contain all certified life safety upgrades required for the building to obtain a passing score.

Meeting the requirements of the Life Safety Evaluation Ordinance is a multi-step process:
  1. The Design Professional selected by building ownership must inspect and evaluate the subject Building and submit the LSE report to the Department of Buildings and the Fire Department.
  2. The Department of Buildings and the Fire Department must approve and accept the building’s Life Safety Evaluation (LSE) Report.
  3. By December 31, 2014, all construction required to comply with the individualized Life Safety Evaluation (LSE) report must be completed and verified through inspection by the Department of Buildings and the Chicago Fire Department.  Building permits must be obtained for the installation of any recommended upgrades to your building’s life safety structures or systems.  The Department of Buildings has created a streamlined permit process for LSE related construction work.

Disconnect your downspouts

The City of Chicago was the first major metropolitan area in the country to successfully implement an inlet control system to relieve basement flooding. The system works by installing valves to slow the flow of storm water into the sewer system. Storm water is detained on city streets for brief periods before flowing back into the sewer system. This measure helps relieve the burden on the sewer system and reduce the frequency of basement flooding and combined sewer overflows into the waterways.

The effectiveness of the inlet control system depends on the number of roof downspouts that are disconnected from the sewer system. While impractical in some places (where there are only hard surfaces or where drainage could impact neighboring property), the potential to reduce basement flooding and increase natural infiltration is great.

The City actively encourages homeowners to disconnect their downspouts from the sewer system and direct the water instead to their yards or gardens. Downspout disconnection can help prevent basement sewage backup. Before you disconnect your downspout, consider where you are directing the water, and that cold weather will cause icing conditions. When you are completed, your project should be a permanent solution which is beneficial to your grass, flowers, shrubbery and trees. Important Things to Remember:
  • Direct Downspout extensions towards the street or alley to prevent seepage into building foundations or adjacent properties. 
  • Firmly anchored splash blocks should be installed if downspout drainage is to travel over landscaping or dirt.  
  • Do not allow water to splash or pond on adjacent private property. 
  • Make sure downspout extensions end at least three feet away from basement foundations, and water is being directed on ground that slopes away (downward) from your building.

I paid the fine, do I need to comply?

Carbon Monoxide and building codes

On June 23, 2014, Mike McClintock, Special to Tribune Newspapers reported an article titled "Guarding against silent, deadly carbon monoxide"

He stated that unlike smoke you can smell and flames you can see, carbon monoxide (CO) is a colorless and odorless gas that gives no hint of its lethal presence. It flows in the exhaust of water heaters, furnaces and anywhere there's a flame. It can kill in minutes, you don't cough or wake up to a noxious smell. You just don't wake up.

That's why building codes about removing CO are so stringent. They cover the kind of exhaust pipe you can use, the construction of flues, how close a sidewall vent can be to a window, even how high above the roof a flue must be to release the gas so it can't flow back into the building.

He explains that as a natural byproduct of combustion, CO is not some remote environmental threat. It comes out of automobile exhaust pipes, utility company smokestacks, backyard barbecues, and for the most part does not pose a health threat outside the house. However, inside is another matter. In tightly built energy-efficient homes, even small CO leaks can build to deadly concentrations. A small crack in a flue or a slightly loose connection between metal vent pipes can release the gas.

Chicago Building Code Violation Defenses

It is a defense to a building code violation if we can prove to the administrative law officer that:
  1. The building code violation alleged in the notice did not in fact exist at the time of the inspection resulting in the notice
  2. At the time of the hearing on the issue of whether the building code does or does not exist, the violation has been remedied or removed
  3. The building code violation has been caused by the current building occupants, or the most recent occupants who have been evicted within 30 days of the date of the notice of building code violations, and that in spite of reasonable attempts by the owner, manager or person exercising control to maintain the building free of such violations, the current or evicted occupants caused the violations
  4. An occupant or resident of the building has refused entry to the owner or his agent to all or a part of the building for the purpose of correcting the building code violation.

Did your tenant complain to the city?

Basement De-conversion

According to the City of Chicago, for basement de-conversions the owner (if owner-occupied) may fill out a Certificate of Responsibility to remove partitions as well as an Easy Permit Application.  If the property is not owner-occupied,  then one needs a signed contract from a General Contractor.  Also, a plumber’s letter of intent is needed  (for cap and seal kitchen) as well as an electrical permit (applied for online) to remove any electrical components in the walls before they are taken down.  One may keep the basement bathroom depending on how a particular violation is written.  If the violation states "remove all partitions", then the bathroom must be removed as well.  However, Plumbing fixtures may be kept for a washing machine.

What is a Conservation Inspection?

The City of Chicago,  Division of Building Inspections, more commonly known as "Conservation", is charged with enforcing the Chicago Building Code as it relates to the City's existing housing stock. Inspection activities include yearly inspection of over 22,000 "Annual" buildings, court ordered re-inspections, license application inspections, inspection of public places of assembly, surveys, and exterior wall inspections.

The bulk of their inspections are generated by citizen complaints. These complaints vary in the degree of severity and range from insufficient heat in dwelling units to bricks falling from buildings.

If you own property in Chicago, make sure you keep current with the maintenance of your property.
