What happens at a hearing?

Generally speaking, hearings are held at 400 West Superior or at the Daley Center in Chicago. At a Chicago building code violation hearing, both sides present their case to the administrative hearing officer (the judge). The City of Chicago will have an attorney working hard on their behalf. Are there any defenses to building code violations?


Yes, there are some defenses to building code violations.

It is a defense to a building code violation if we can prove 1) the building code violation alleged in the notice did not in fact exist at the time of the inspection resulting in the notice; 2) At the time of the hearing on the issue of whether the building code does or does not exist, the violation has been remedied or removed; 3) The building code violation has been caused by the current building occupants, or the most recent occupants who have been evicted within 30 days of the date of the notice of building code violations, and that in spite of reasonable attempts by the owner, manager or person exercising control to maintain the building free of such violations, the current or evicted occupants caused the violations; and 4) An occupant or resident of the building has refused entry to the owner or his agent to all or a part of the building for the purpose of correcting the building code violation.

My tenant called the department of buildings!

My tenant called the department of buildings on me!  Can I have them evicted? No.  The law clearly states the following:


2-14-154 Rights of occupants.
No action for eviction, abatement of a nuisance, forcible entry and detainer or other similar action, including but not limited to increase of rent, decrease of services and refusal to renew a lease, shall be threatened or instituted against an occupant of a building or other structure because such occupant has in good faith agreed to testify or testified at an administrative hearing before the Department of Administrative Hearings or has complained of a building code violation to the landlord, to a government agency, public official or elected representative, or to a community organization or news medium. Nothing in this section shall be construed to limit any rights or defenses available to tenants or other occupants under other city ordinances or applicable law.

The most common building code violation is....

13-12-030

"The owner of any building having residential units designed or used for two or more family units or designed or used for sleeping accommodations, other than family units, for more than ten persons shall post, or cause to be posted, in a prominent place in a common area of the building accessible from the public way, or affixed to the building so as to be visible from the public way, the name, address, and telephone number of the owner, his agent for the purpose of managing, controlling or collecting rents and any other person managing or controlling such building."

Department of Buildings Requiring 50 Percent Fee with all Permit Applications

The Department of Buildings will start requiring a 50 percent deposit on permit applications on January 3, 2012.

The deposit requirement is designed to recoup a portion of the cost the department incurs for reviewing and approving plans that are never completely permitted and also to discourage design and building professionals for submitting plans for projects that may not yet have financing.

Currently, permit fees are not assessed until the end of the process when the applicant picks up the permits. Hundreds of permits are reviewed and approved each year for which applicants do not pay or complete the process.

“Our plan examiners spend time and effort reviewing all drawings that are submitted,” said Michael Merchant, Commissioner for the Department of Buildings. “Reviewing plans that never complete the permit process forces other projects to wait longer for their permit times. Charging a deposit will allow us to capture part of the fees owed to us without overly burdening submittals at the start of the process and allow other projects to move along quicker.”
