What to expect at the hearing

Generally speaking, for City of Chicago building code violations, most hearings are held at 400 West Superior or at the Daley Center in Chicago. At a Chicago building code violation hearing, both sides present their case to the administrative hearing officer (the judge). The City of Chicago will have an attorney working hard on their behalf. I dont know what to do with this property....

I received a call last week from a man who was cited by the City of Chicago for a variety of violations.  He told me that he had enough, he did not want to deal with this property anymore.  He was not making any money and now he had to deal with all of these violations.

Why did the City cite me for building code violations?

Many people are cited for building code violations every day by the City of Chicago.  In many cases, I believe a neighbor or a tenant calls 311 to report a possible violation.  The City then sends out an inspector to determine whether any violations exist.  I also believe the City Inspectors  go up and down alleys to look at porches, decks, and other violations.

Defenses to building code violations

There are not many defenses to building code violations which is why its so important to have attorneys who know how to work out a deal with the city attorneys.  There are some defenses though and here they are:

It is a defense to a building code violation if we can prove 1) the building code violation alleged in the notice did not in fact exist at the time of the inspection resulting in the notice; 2) At the time of the hearing on the issue of whether the building code does or does not exist, the violation has been remedied or removed; 3) The building code violation has been caused by the current building occupants, or the most recent occupants who have been evicted within 30 days of the date of the notice of building code violations, and that in spite of reasonable attempts by the owner, manager or person exercising control to maintain the building free of such violations, the current or evicted occupants caused the violations; and 4) An occupant or resident of the building has refused entry to the owner or his agent to all or a part of the building for the purpose of correcting the building code violation.

Porches, porches, porches

I honestly believe inspectors from the department of buildings are driving up alleys looking at back decks and porches.  And if they believe the deck or porch does not comply with the building code, they will cite you!

Sometimes the entire deck or porch will need to be torn down, sometimes it can me "modified" and allowed to pass.  Either way, the fine can be $500 per day so dont take it lightly.  If you have been cited with building code violations in the City of Chicago, call our office right away.
