According to the Municipal Code of Chicago, Chapter 13-196-410, the dwelling needs to have heat available from September 15th of each year to June 1st of the succeeding year at a minimum temperature of 68 degrees from 8:30 a.m. until 10:30 p.m. and 66 degrees at 10:30 p.m. to 8:30 a.m., averaged throughout the family unit or rooming unit.

What is future Non-Suit?


A Future Non-Suit means the City attorney or the enforcing department has decided not to proceed to a hearing to enforce the ticket or a particular count of the ticket. The Administrative Law Judge will not decide the case pertaining to a charge that is non-suited.  In some cases, the City attorney may decide to re-file the citation and proceed to hearing at a later date.

What is a Complaint?

Complaint-this is the initial pleading which initiates a case.  In an administrative adjudication this is usually in the form of a notice of ordinance violation, ticket or citation that is written by a police officer, City inspector or other City employee.  The ticket alleges that the respondent named in the ticket has violated a section of the municipal code.  The ticket will usually contain a brief description of the supporting facts and state what the City is asking for, such as a fine, repairs to property, or some other penalty to be imposed against the respondent.

What does the term "Standing" mean?

Standing-the right to be a party to a hearing or to assert a claim. An Administrative Law Judge might dismiss a case based on a person having no standing if the person would not be affected by the outcome. For example, if person A files a case asserting that they are the responsible party although person B is indicated, the Administrative Law Judge might find that person A has no standing.

Party: One of the participants in a hearing. The parties to the administrative hearing are identified on the ticket or notice of violation. They are often given special names in an administrative hearing, depending on the type of hearing.  These names might be respondent (you), appellant, petitioner or witness. City of Chicago and a Prima Facie case

Prima facie case means the City has presented sufficient evidence to prove that a Municipal Code violation has occurred and that the Respondent is responsible for the violation.  The City can establish a prima facie case through a notice of violation (ticket) or written complaint signed by a City employee (such as a police officer or inspector) and/or evidence (such as photographs, documents and/or the testimony of one or more witnesses). 

If the City fails to present a prima facie case, the Respondent need not present any evidence at all. However, if the Administrative Law Judge decides that the City has established a prima facie case, the Respondent should be prepared to present Respondent's own evidence (testimony, photographs, documents, etc.) to rebut the City's prima facie case.

What is a LLC?

LLC stands for Limited Liability Company. Like a corporation, a LLC is a separate and distinct legal entity. This means that a LLC can obtain a tax identification number, open a bank account and do business, all under its own name.

City of Chicago provides resources to help keep residents safe during extreme heat

On July 17, 2015, The Chicago Department of Public Health (CDPH) and Department of Family and Support Services (DFSS) reminded residents to be aware of extreme temperatures and to be sure to take the necessary precautions to avoid heat-related emergencies. Residents are urged to call 311 for well-being checks, and to check in on neighbors and seniors.

To Prevent Heat Related Illness:
  • Keep your body cool. Take cool showers or baths if necessary.
  • Stay in air conditioned buildings as much as possible. If you don’t have access to air conditioning, call 311 to find the nearest cooling center. DO NOT rely on a fan as your primary cooling source.
  • Be sure to monitor weather forecasts so you can plan your activities safely when it’s hot outside. Avoid going out in the heat during the hottest part of the day.
  • If you do go out, wear light, loose-fitting clothing---and wear a hat to protect your head. Use sunscreen and reapply as directed on the package. If you’re exercising or working outside, pace yourself and drink more water than usual and don’t wait until you are thirsty to drink more. If possible, take breaks to cool off in an air conditioned room and always have a partner with you.
  • NEVER leave infants or children in a parked car. Nor should pets be left in parked cars—they can suffer heat-related illness too.
  • Check on your relatives, friends and neighbors and share these tips with them. The elderly, those who live alone, those who are ill and young children are most vulnerable to extreme heat and humidity.
Resources Available to Keep Safe and Cool:
  • DFSS coordinates the operation of cooling centers, provides transportation to them and conducts well-being checks on at-risk residents, including seniors.
  • The Garfield Center, located at 10 S. Kedzie, is available 24 hours a day, seven days a week to connect residents to emergency shelter.
  • In addition, the King Center (4314 S Cottage Grove) and North Area Center (845 W. Wilson) will be open as cooling centers from 10:00 a.m. to 5:00 p.m.
  • Additional city facilities including libraries, police stations or other structures might be made available after hours, on weekends, or on holidays, as conditions warrant.
  • Seniors or individuals with limited mobility may call 311 to request transport to the nearest cooling center.

City of Chicago Permit information

The City of Chicago posted the following permit information to keep in mind:

* Easy Permit Process (or EPP) applications are frequently issued the same day.

* Permit applications with drawings may take longer. There may be Code required changes to drawings, the need for required documents or additional required information.

* Projects that require special approvals from Zoning, Landmarks, Planning & Development, include a new driveway, are subject to Excavation Certification requirements, or need required contractors may take longer.

* Return visits may be necessary to address corrections to drawings and to get more required information (which may include contractors).

* Homeowners have the option to hire an expeditor or architect to submit plans for permit, at their expense. Expeditors and architects are ineligible to use the Neighborhood Residential Permit Centers on behalf of a client. These licensed professionals must utilize the electronic permit application and review system.

City of Chicago Neighborhood Permit Centers

The City of Chicago, Department of Buildings’ Neighborhood Residential Permit Centers offer special permit services for owner-occupants of single-family homes through the Homeowner Assistance Plan Review and owner-occupants of two-unit or three-unit residential buildings through the Easy Permit Process. This means only the owner who lives in the home/building where the work will occur may apply for a permit (NO ARCHITECTS, EXPEDITORS, or GENERAL CONTRACTORS).

Most other permits, including permits for new buildings, must be submitted at City Hall through other permitting processes.

The city advises that the Neighborhood Residential Permit Centers can become quite busy, especially in the late spring, all summer and the early fall. Homeowners are served on a first come first served basis. Neighborhood Residential Permit Centers are located at:

Window safety

To protect the safety of Chicago residents, primarily children during the warm summer months, the Department of Buildings and the Chicago Department of Public Health are reminding residential building owners, occupants and parents to install operable window guards on windows and limit window openings to 4 inches or less, and to secure door openings with proper screens.

Installing building code-compliant devices that limit how far windows will open can also help keep children safe from falling.  Children should be kept away from open windows and doors when playing. Parents should avoid the placement of furniture such as beds, dressers and cribs near windows to prevent children from climbing onto window sills.

In addition, the Chicago Building Code requires every door opening and every window to have screens in place from April 15th to November 15th of each year. Specifically, every door opening directly from any family unit to the outdoors and every window, or other outside openings used for ventilation purposes, must be supplied with a screen of not less than 16 mesh per inch and every screen door shall have a self-closing device in good working condition.  Screens also prevent mosquitos and other pests from entering homes.

In total, the Department of Buildings issued 1,526 violations for window-related violations in 2014.

Garage permits and demolitions

In the City of Chicago a permit is required to tear down/remove a garage. The City of Chicago published the following situation on their website which may be helpful to explain why a demolition permit may also be required: 

Q: I recently bought my house and there was no garage. I then applied for a permit but it was not issued. I was told that I needed a demolition permit before I would be allowed to apply for a permit for a new garage. Why was the permit not granted?

A: According to the city records, there was a garage at that address at one time, but the previous owner demolished it, without a permit. The city will not issue a permit at a site if there is no record of a permit to remove the previous structure.

Information on the City of Chicago Demolition Process

The Department of Buildings' Demolition Bureau responds to complaints generated by the 311 system reported by residents, community groups, Aldermanic offices, as well as the Chicago Police Department. The bureau responds to complaints of vacant and open buildings. Buildings that are abandoned and scenes of criminal activity are inspected and then referred to the Circuit court system. The process consists of identifying a responsible party who will secure, rehab, sell or raze the structure. If these standards cannot be met, the Demolition bureau continues to inspect the building throughout the court case. In some cases, the court may order the premises to be properly secured, or ultimately demolished.

The City of Chicago, Department of Buildings Reminds Building Owners...

...to keep decks and porches safe for outdoor use and repair and maintain structures in accordance with the Chicago Building Code. On June 3, 2015, they posted the following information on their website:

"As we quickly move into the warmer months in Chicago, the Department of Buildings reminds residents to take time this spring and early summer to inspect decks, porches, balconies and stairs for needed repairs and to always use decks and porches safely during the warm summer months.

"Property owners need to be mindful of building maintenance, including checking decks and porches for any wear and tear and immediately addressing unsafe conditions," said Buildings Commissioner Felicia Davis. "Safety doesn’t end with an inspection, and we remind residents to properly use decks and porches during the summer and limit the number of people on these structures."

Residents should check for important signs of deterioration, including:
  • Split or rotting wood, or evidence of water damage
  • Loose, missing or rusting hardware or bolts
  • Loose or missing anchors where the porch attaches to a building
  • Missing, damaged or loose support beams and planking
  • Excessive movement of the structure when walked on
  • Wobbly handrails or guardrails
If problems are identified, stop using the porch, balcony, deck or stairs immediately. Renters should report the concerns to the building owner or property manager. If the problem is not quickly addressed, renters should call 311 and request an inspection. Owners are required by law to make necessary repairs and maintain their property in a safe condition.

The Department of Buildings inspects approximately 5,000 porches each year as part of annual inspections of buildings. Due to greater awareness and stricter code requirements, the number of 311 complaints about potentially dangerous porches has been reduced over the years.

In 2014, the Department of Buildings received 1,923 porch-related complaints and issued 2,405 permits to repair, replace or build new porches. The number of permits issued to repair or build new porches continues to remain consistently above 2,000 each year, an indication that porches are being maintained. In 2012 and 2013, the Department issued 2,028 permits and 2,494 permits respectively.

City of Chicago Boiler Inspections

The Boiler Inspection Bureau makes periodic inspections of boilers and unfired pressure vessels at all apartment buildings where the boiler heats four or more apartments, commercial buildings, schools, churches, hospitals, nursing homes, etc. Types of inspections performed by the boiler inspection bureau are as follows:

Internal Inspection: Performed on high pressure boilers or low pressure boilers used for processing. This inspection enables the inspector to see the condition the unit is in internally, checking for tube leakage, pitting of the tubes, etc. Whenever necessary, internal inspection will be performed on a pressure vessel.

External Inspection: Performed on all boilers and unfired pressure vessels. This inspection, in part, consists of checking safety valves, return lines, breeching, etc. while unit is in operation. 

Occupancy Inspection: Performed on boilers and pressure vessels installed in a new or existing buildings to ascertain units have been properly installed and all required permits have been obtained. 

First Inspections: First inspections derive from permits taken out for newly installed boilers and pressure vessels at the Environmental Desk. A copy of the permit is send to the boiler inspection bureau.

Hydrostatic Test: Performed on new or used boilers newly installed to check condition of unit, or when extensive repairs have been made on an existing boiler

Boiler Inspection Questions and Answers

Q: Why is our boiler inspected every year?

A: The Chicago Building Code states all boilers and pressure vessels must be inspected annually.

Q: Why do boiler inspectors also inspect pressure vessels?

A: Boilers and pressure vessels are constructed similarly. Essentially, a boiler is a pressure vessel.

Q: Who can repair my boiler?

A: Any Boiler Contractor who is licensed with the City of Chicago.

Chicago's Conservation Inspection

The Division of Building Inspections, more commonly known as "Conservation", is charged with enforcing the Chicago Building Code as it relates to the City's existing housing stock. Inspection activities include yearly inspection of over 22,000 "Annual" buildings, court ordered re-inspections, license application inspections, inspection of public places of assembly, surveys, and exterior wall inspections.

The bulk of their inspections are generated by citizen complaints. These complaints vary in the degree of severity and range from insufficient heat in dwelling units to bricks falling from buildings. Part 2: Obtaining a City of Chicago Certificate of Occupancy

Obtaining a City of Chicago Certificate of Occupancy requires the following steps:
  • The applicant must submit required technical and contact information on the Certificate of Occupancy Form.
  • The completed form can be submitted to the Department of Buildings from the City of Chicago website.
  • Upon receipt of a completed application, the Department will schedule a certificate of occupancy inspection and notify the applicant. If the applicant wants to change or cancel a scheduled appointment, the applicant must notify the Department at least two business days prior to the appointment.  
  • The Department will send the certificate of occupancy application to the Fire Department for approval prior to issuance.
The following inspections ARE REQUIRED and MUST be requested at the following intervals:
  • Underground Inspections of underground plumbing and rebar, structural steel prior to concrete pours (initial and ongoing)
  • Rough inspections of carpentry (new construction), electrical, iron, plumbing and ventilation
  • Final inspections of boilers, carpentry (new construction), electrical, iron, plumbing, refrigeration, ventilation and Certificate of Occupancy inspection.
The applicant or the authorized representative of the applicant must follow these on-site inspection requirements:
  • Be present at the time of the scheduled certificate of occupancy inspection;
  • Make sure a representative for any technical trade is present at the inspection, if requested by the department;
  • Make available at the inspection the full set of stamped permit plans and any technical document approved by the department;
  • Make sure that all rooms and spaces required to be inspected can be accessed; and
  • Provide all equipment required by the Department to undertake the inspection, including but not limited to, ladders, safety equipment, and lighting.  
A reinspection fee, as provided in section 13-20-051 of the Building Code, shall be assessed whenever any scheduled certificate of occupancy inspection cannot take place because of the absence of, or other action or inaction by, the building’s owner or permit holder. The reinspection fee shall be paid to the director of revenue before a certificate of occupancy is issued.

Part 1: City of Chicago's Certificate of Occupancy

A Certificate of Occupancy is issued by the Commissioner for the Department of Buildings certifying that a building conforms to the general, special, and structural requirements of the Chicago Building Code applicable to new multiple dwellings.

A Certificate of Occupancy is required for buildings that meet one of the following criteria:
  • New Construction of a Single Family Dwelling and Multiple Dwelling Residence with no more than 3 dwelling units
  • Multiple dwelling units consisting of four or more units erected or substantially rehabilitated
  • Newly constructed non-residential buildings over 4,000 square feet.
  • Alternations or repairs of non-residential buildings exceeding $400,000 in estimated (material) cost.
  • Work in existing buildings resulting in a change of occupancy, as "occupancies" are defined in Chapter 13-56 of the Chicago Building Code, "Classification of Buildings by Occupancy." See the code online for more information.
  • Substantial work performed in a new or existing building of Institutional of Assembly use, as defined by the code.
Please note that the owner of any newly constructed, altered or modified building and/or the permit holder for the construction, alteration or modification of any building may not occupy the building or cause others to occupy such building.

There are penalties

Don't procrastinate if you have been cited for a building code violation. According to the Chicago Municipal Code, any person found guilty of violating any building code provision shall receive a fine of not less than $300.00 nor more than $500.00 upon conviction for each offense. A separate and distinct offense shall be regarded as committed each day the violation continues. In addition, any license or permit issued to a violator or offending party by the City of Chicago may be revoked and, the city shall also have the right to seek mandatory compliance or in the alternative to seek demolition of a building not in compliance.

Child Window Safety

The City of Chicago is urging residents and landlords to take measures to keep children safe at home. They advise that too often, children are seriously injured or killed as a result of falling from a window and are providing the following basic steps you can take to help make sure children stay healthy and safe at your home. 

Steps for parents and residents:
  • Limit window openings to 4 inches or less.
  • Install operable window guards on windows.
  • Avoid the placement of furniture such as beds, dressers and cribs near windows to prevent children from climbing onto window sills.
  • Keep children away from open windows and doors when playing.
Steps for landlords and building owners:
  • Install building code-compliant devices that limit how far windows will open.
To further promote life safety, the Chicago Building Code requires every door opening and every window to have screens in place from April 15th to November 15th of each year. Specifically, every door opening directly from any family unit to the outdoors and every window, or other outside openings used for ventilation purposes, must be supplied with a screen of not less than 16 mesh per inch and every screen door shall have a self-closing device in good working condition.

The City of Chicago encourages residents to call 311 if they see windows that present a potential danger and a building inspector will be sent out.

May is the City of Chicago's Building Safety Month

The Department of Buildings supports the safety and quality of life for the residents and visitors of the City of Chicago through the enforcement of the Chicago Building Code. City of Chicago's Historic Preservation Division

The City of Chicago, Department of Planning and Development's Historic Preservation Division works with property owners, city departments, sister agencies, and the general public to promote the preservation of Chicago's historic resources.

The division researches and prepares landmark designation reports and reviews permit applications for work on proposed and designated landmarks. It also administers the Demolition-Delay Ordinance, maintains the Chicago Historic Resources Survey, and promotes the preservation of historic buildings through incentives, preservation planning, public outreach, and technical assistance. The division staffs the Commission on Chicago Landmarks, which is responsible for recommending potential landmark designations to the City Council.

The Municipal Code

The Municipal Code is a published compilation of City laws and their revisions organized according to subject matter (arranged by title, chapter and section). The Municipal Code is updated periodically as new ordinances are adopted by the City Council.

On March 18, 2015, the City of Chicago announced the new ChicagoCode.org providing one-stop access to the Chicago Municipal Code.  This will give residents, business owners and government workers the most accessible, user-friendly, and interactive way to access the Chicago Municipal Code on the Internet. The Chicago Municipal Code is thousands of pages long and includes everything from the building code to rules about where you can park on a Sunday afternoon.

ChicagoCode.org is a non-profit, non-governmental, non-partisan implementation of The State Decoded, developed and administered by The OpenGov Foundation. The data that powers ChicagoCode.org is made available online to the public by the City of Chicago via American Legal Publishing.  The official code is maintained by the City of Chicago and the Office of the Chicago City Clerk.
