City of Chicago Building Permits

The Chicago Department of Buildings recently announced a more than 150 percent increase in building permits issued through mid-November 2014 for small to mid-size new construction projects as compared to the same period in 2010, and a steady increase year over year. So far in 2014, the City issued 1,436 building permits in this category compared to 573 in 2010, an increase of 863 permits.

In anticipation of the uptick in building permits, Chicago rolled out its E-Plan system in 2012 for paperless processing of over half-a-million design documents each year. The innovative E-Plan system facilitates multi-discipline review and tracking of projects through every step of the process, allowing design professionals to submit plans electronically from the convenience of their offices, multiple plan reviewers to examine and approve plans simultaneously, and design professionals to receive corrections and approvals in real time.

Throughout 2014, and in collaboration with the Zoning Division of the Department of Planning and Development, the Department of Buildings made technical improvements to the E-Plan system including a new process for archiving inactive projects, design professional training for a better project description on the building permit application to help reduce number of permit reviews and improved communication between departments with regular meetings to discuss enhancements and progress.

Other building permit process improvements made this year include a new welcome desk at City Hall for customer concerns and questions, a new process to accommodate the requests for in-person meetings to clarify building and zoning code questions, and additional staff for the Neighborhood Residential Permit Centers trained and dedicated to meeting homeowners’ needs for building permits.

With over 40,000 building permit applications processed yearly, the Chicago Department of Buildings oversees one of the largest permitting operations in the country issuing many types of building permits including repair and replace permits, small and midsize new construction/renovation and large-scale development projects.

Seniors you may be eligible for a permit fee waiver

It is important that you to obtain a building permit before starting a project so you do not end up with a Building Code Violation. Did you know that the City of Chicago offers waivers of the permit fees for senior citizens for projects that meet the following criteria:
  • Building Owner must be 65 years old or older.
  • The Building Owner must have owned the building for at least 10 years.
  • The Building Owner must have lived in the building for at least the last ten years. 
  • The scope of work for the permit is for repair, renovation, alteration, or additions to a building with three or less dwelling units.
  • The income level of the Building Owner is no more than 80% of the Chicago area median family income as calculated by the U.S. Department of Housing and Urban Development.

  • Winter proof homes by covering windows with plastic sheeting, applying weather stripping around doors, insulating hot water pipes and installing programmable thermostats.  These measures are important tools during the heating season to help manage energy costs.
  • Have appliances serviced by qualified contractor.  Keep heating, ventilation and metering equipment free from debris, snow and ice. Ensure natural gas appliances are correctly flued and have the correct ventilation to avoid carbon monoxide build up in living areas. Check/Install carbon monoxide detectors

The Chicago Heat Ordinance

The Chicago Heat Ordinance mandates that landlords supply heat to rental units during cold weather months.  From September 15 to June 1, the temperature inside a rental residence must be at least 68 degrees during the day.  During the evening, the temperatures must be at least 66 degrees.  The Department of Buildings encourages residents to first contact their landlords when these temperatures are not maintained and to call 3-1-1 if no action is being taken.  During extreme cold weather, however, the Building Department’s first priority is responding to heat complaints and it reassigns inspectors to handle the increased number of heat complaints.

On November 15, 2014, the City of Chicago reported that since September 15th, the Department of Buildings has completed 1,579 no heat inspections, referred 65 buildings to Administrative Hearings and referred 50 buildings to the Department of Law to process for Circuit Court. To date, 30 cases have been filed by the Department of Law, impacting 388 residential units and a Heat Receiver has been appointed for 15 properties, impacting 177 residential units. This week, the Department of Buildings also conducted a blitz inspection of 14 repeat offender properties to ensure residents are provided adequate heat and to cite the owners for any violations, including installing and maintaining smoke and carbon monoxide detectors. As a result, six of these buildings are being processed for Circuit Court.

Space Heaters

As the winter chill takes hold, Mayor Emanuel joins City Departments to remind residents to take precautions during the cold weather.

The Chicago Fire Department (CFD) does not recommended using space heaters; however, if used, be sure they are UL certified and at least 3 feet from anything that can ignite. Use of a space heater in children’s rooms should be monitored closely as children sometimes move them close to or into the bed with tragic results. If extension cords are used, they should be rated at 15 amps minimum and never put cords under carpet.

With the added demand on furnaces and boilers, CFD also reminds residents that they are required by ordinance to have working carbon monoxide detectors to protect against carbon monoxide leaks from a heating system that could be fatal over time.

Important public safety ordinance announcement

On October 8, 2014, Mayor Emanuel and Aldermen Burke, Balcer and Solis introduced an important public safety ordinance that repeals a dangerous post-citation compliance defense for residential landlords who forego the installation of smoke detectors and carbon monoxide detectors.

Earlier this month, four children tragically lost their lives in a residential fire in which there were no working smoke detectors,” said Mayor Emanuel. “The law as written provides no incentive for landlords to install smoke and carbon monoxide detectors in their units, as they can comply after they are ticketed to avoid a fine. There is no excuse for landlords who seek to avoid the minimal cost and labor to install smoke and carbon monoxide detectors, and this proposed ordinance will strengthen the laws we have to enforce these important public safety provisions.”

The proposed ordinance amends the building code for smoke and carbon monoxide detectors to hold residential landlords accountable by eliminating the defense and creating a daily fine range for these specific life threatening violations. The ordinance would specifically repeal post-citation compliance as an affirmative defense to violations relating to smoke detectors and carbon monoxide detectors and increased the daily minimum fine from $300 per day to $500 per day and sets the maximum fine at $1,000 per day.

Boiler Inspections

The City of Chicago, Boiler Inspection Bureau makes periodic inspections of boilers and unfired pressure vessels at all apartment buildings where the boiler heats four or more apartments, commercial buildings, schools, churches, hospitals, nursing homes, etc.

The Chicago Building Code states all boilers and pressure vessels must be inspected annually. Additional information can be found on the City of Chicago's website.

Carbon monoxide detectors

The City of Chicago, Department of Buildings will issue a violation notice if  you have not installed a carbon monoxide detector. The owner of the building must install detectors where required and provide tenants with written information regarding testing and maintenance. The end of Daylight Savings Time on November 2nd is an ideal time to replace smoke alarm and carbon monoxide detector batteries.

Does your property have a garage on it that needs to be demolished?

The City of Chicago, Department of Buildings has developed an efficient process for wrecking residential garages.  When a garage needs to be removed and will not be rebuilt, the city will issue a permit with an Easy Permit Application. Requirements for this permit include:
  • An Easy Permit Application completely filled out with the owner’s signature and the garage dimensions.  The Property Index Number (PIN) must also appear on the application.
  • A signed contract between both owner and contractor detailing the scope of work; and including the stipulation that all debris will be removed from the site and disposed of at a proper facility.
  • Interior and exterior pictures of the existing garage.
  • No sign offs will be required from any other department, except from the Department of Water Management.When plumbing piping is supplied to the garage a B-Permit (to disconnect water) is required from the Department of Water Management. Water supply must be disconnected by a licensed and bonded plumbing contractor.
  • This type of permit will only be issued with a licensed General Contractor, Wrecking Contractor or Garage Company.  The fees will be $125.00.

When is a building permit NOT required?

A building permit is required to ensure that the project you are constructing conforms to the minimum standards of the Chicago Building Code.  The Chicago Building Code exists to safeguard the public health, safety and welfare.A building permit is NOT required for the following repair or replacement work at any building:

Interior finishes such as carpet, hardwood flooring, tile, paint and wallpaper
Interior non-fire rated ceiling tiles (excluding grid)
Cabinetry and furniture without electrical and plumbing connections
 In-kind replacement of non-fire rated interior doors
At grade non-combustible walkways and patios
Playground equipment
Fences max. 5’-0” high on private property (excludes landmark buildings and landmark districts as well as chain link and masonry fences)
Vinyl, aluminum, wood, EIFS or other similar nonstructural exterior finishes on all one story buildings except Hazardous occupancy (excludes landmark buildings and landmark districts)

If you are caught without a permit, you may receive a costly Building Code Violation. The City of Chicago can also review your buildings past history and cite you for something that happened years ago in which you did not obtain a permit. When is a building permit required?

Building permits give you, your insurance company, neighbors and the City of Chicago assurance that specific minimum standards are met in constructing, repairing or altering your home or building by complying with the Chicago Building Code. These standards are intended to protect the integrity of the buildings, the welfare of the public and your safety. Types of Projects That Require Permits:

Additions – room, upper floor, expansion
Attic – finish, renovate
Basement – finish, renovate
Boiler – install, replace
Carport – install, replace
Chimneys – replace, erect
Conversion of units – single to multiple
Deck – build, replace
Deconversion of units – multiple to single
Demolition – garage, home, building
Dormers – installation
Driveways – installation
Electrical system – alteration, expansion
Fence – taller than 5 feet, may not exceed 6 feet. For Landmark buildings only, a permit is needed for any solid fence of any height visible from a public street*
Furnace – install, replace
Garage – build attached, detached
Gut rehab – complete modernization
Hot Water Heater – install, replace
Masonry – replace, install face brick
Natural light and ventilation – skylight
New Construction – homes, high-rise, retail, business
Plumbing system – construct, alteration
Porch – build, replace, enclose, renovate
Security Alarm – installation
Siding Replacement-For Landmark buildings only*
Roof – slope less than 5-in-12
Ventilation system – mechanical, supply
Windows and Exterior Doors-For Landmark buildings only*

*If a building has been designated a Chicago Landmark or as part of a Chicago Landmark District, one should check in with the Landmarks Division prior to getting a permit. Applicants of Landmark properties are encouraged to contact the Landmark Commission staff prior to submitting an application to ensure that the application will include all the necessary information.

Heat to be furnished in residential buildings

According to the Municipal Code of Chicago, Chapter 13-196-410: Every family unit or rooming unit to which heat is furnished from a heating plant used in common for the purpose of heating the various rooms of the dwelling shall be supplied with heat from September 15th of each year to June 1st of the succeeding year so that the occupants of a family unit or rooming unit may secure, without such undue restriction of ventilation as to interfere with proper sanitary conditions, a minimum temperature of 68 degrees at 8:30 a.m. and thereafter until 10:30 p.m. and 66 degrees at 10:30 p.m. and thereafter until 8:30 a.m. averaged throughout the family unit or rooming unit.

Working Smoke Alarms Save Lives!

Along with firefighters and building safety advocates nationwide, Chicago Fire Department and Chicago Department of Buildings are joining forces with the nonprofit National Fire Protection Association (NFPA) during Fire Prevention Week, October 5-11, to remind local residents about the importance of having working smoke alarms in the home and testing them monthly.

This year’s Fire Prevention Week campaign includes the following smoke alarm messages:
  • Install smoke alarms in every bedroom, outside each separate sleeping area and on every level of the home, including the basement.
  • Interconnect all smoke alarms throughout the home. This way, when one sounds, they all do.
  • Test alarms at least monthly by pushing the test button.
  • Replace all smoke alarms when they are 10 years old or sooner if they don’t respond properly.
  • Make sure everyone in the home knows the sound of the smoke alarm and understands what to do when they hear it.
  • A smoke alarm should be on the ceiling or high on a wall.  Keep alarms away from the kitchen to reduce false alarms.  They should be at least 10 feet away from the stove. But no more than 15 feet away from bedroom doors
If you live in a rental building, it’s important to remember it is the responsibility of the tenant to provide and maintain functional batteries for each detector, to regularly test and maintain the detector in the dwelling units, and to notify the owner in writing of any deficiencies. The end of Daylight Savings Time on November 2nd is an ideal time to replace smoke alarm and carbon monoxide detector batteries.

What is a Building Code Complaint?

This is the initial pleading which initiates a case.  In an administrative adjudication this is usually in the form of a notice of ordinance violation, ticket or citation that is written by a police officer, City inspector or other City employee.  The ticket alleges that the respondent named in the ticket has violated a section of the municipal code.  The ticket will usually contain a brief description of the supporting facts and state what the City is asking for, such as a fine, repairs to property, or some other penalty to be imposed against the respondent.

What is a Building Code Violation Stipulation?

Stipulation: An agreement between all parties to a hearing.  For example, during a pretrial conference the parties might stipulate (or agree) to some or all of the facts, and therefore will not have to present evidence about those facts.  Stipulations will either be made in writing before the hearing or may be stated on the record by the parties after the hearing begins.

What is a Prima Facie Case?

Prima facie case means that the City has presented sufficient evidence to prove that a Municipal Code Violation has occurred and that the Respondent is responsible for the violation.  The City can establish a prima facie case through a notice of violation, a written complaint signed by a City employee and/or evidence such as photographs, documents and/or the testimony of one or more witnesses.

Default:  The failure of the respondent to appear at a hearing. The maximum fine may be assessed for default judgments as allowed by City ordinances.

Found Previously Liable?

What if I am found Previously Liable for a Building Code Violation? What does that mean?

Previously Liable: The disposition of a violation at a hearing after the respondent was found liable for that violation at a prior hearing. Typically, this disposition is used at the hearing to determine fines and penalties, and is usually followed by a finding either that the violation has been brought into compliance or that it is still not in compliance.

If you were found liable, the hearing officer is required by law to impose the penalties set forth by the Municipal Code of Chicago. If the penalty is a set fine, the hearing officer must impose that amount.

Administrative Adjudication and Administrative Record explained

Administrative Adjudication: The legal process by which an Administrative Law Judge decides whether a municipal code violation has occurred after conducting an administrative hearing.

Administrative Record: The official record of an administrative hearing. This will usually consist of the pleadings (such as notice of hearing or notice of violation often referred to as the “ticket”, the request for hearing, the motion to set-aside the default), the hearing exhibits, the testimony given under oath, and the arguments of the parties. The Administrative Law Judge is permitted to consider only the administrative record, as well as the law applicable to the case.

What is an ANOV?

ANOV stands for Administrative Notice of Violation which is a citation/ticket issued by a Chicago police officer, inspector or investigator from a City department which cites the ordinance allegedly violated. The ANOV also includes the date, time, and location of the offense, identity of person named, with details to support the allegation.

What are Strict Liability and Vicarious Liability Offenses?

What Are My Rights at a Hearing?

You have the right to represent yourself or hire an attorney to represent you at your own expense. And, you have the right to tell your side of the story to the hearing officer.

If the city presents its case through the in-person testimony of a city official or other witness, you have the right to ask questions of the city's witness.

If the city presents its case through the sworn affidavit testimony you may have the right to request that the city official attend the hearing so that you may ask questions of that city witness.  However, federal and state case law may not require the physical attendance of that city official at the hearing. Who May Participate in a Building Code Violation Hearing?

Each hearing will have a hearing officer. The hearing officer is a licensed Illinois attorney who presides over the hearing as an independent and impartial "judge."

The city, as the petitioner, may have their attorney there to present its case and, may also bring witnesses to support its case.

You may represent yourself, but it is recommended that you hire an attorney to represent you.

Other respondents may also be present in the hearing room waiting for their case to be called. Because the hearing itself is open to the public, community groups, court advocates or other interested members of the public may be present in the hearing room to observe the proceedings.

Found Liable or Not Found Liable

What If I Am Found Liable for a Building Code Violation?

If you are found liable, the hearing officer is required by law to impose the penalties set forth by the Municipal Code of Chicago. If the penalty is a set fine, the hearing officer must impose that amount. If the penalty has a minimum and maximum fine range, the hearing officer must impose a fine in that range. A hearing officer does not have the legal authority to waive a fine. Penalties may also include: paying restitution (the costs to undo the damage caused by the violation) and/or administrative costs.

What If I Am Found Not Liable for a Building Code Violation?

If you are found not liable, the hearing officer will dismiss the case against you and will not impose any penalties.

How is an Administrative Hearing conducted?

Administrative Hearings while less formal than a state court trial, still follows a basic structure to ensure fairness and due process of law. All testimony is under oath and recorded.

The hearing officer begins by giving opening remarks outlining the hearing process. Since the city initiated the case against you it has to present its evidence before you present a defense. To present its case, the city may: introduce the sworn Notice of Violation of the police officer or city inspector; call witnesses; or offer other evidence such as photographs or other documents.

The city is required to establish what is called a "prima facie case." That simply means that it must set forth the necessary allegations that a code violation may have occurred. The hearing officer reviews the city's case to see if it has alleged all the necessary elements required by law. If the city has not properly alleged its case, the case will be dismissed. If the city has properly alleged a case, the hearing will proceed and you will have the opportunity to present your case.

To present your case, you may, like the city: introduce a sworn affidavit; testify; call witnesses; or offer other evidence such as photographs, receipts or other documents. The city's burden of proof in these matters is "by a preponderance of the evidence," which means that taking everything into consideration, the hearing officer must believe that "it is more likely than not" that a code violation has occurred.

What Can I Do About a Default Judgment?

A "Default Judgment" is similar to a Judge's order in that it can be used to place a lien on your property, garnish your wages and/or affect your credit. The city usually requests that the maximum fine be imposed in default matters. If you:
  1. missed your hearing date for a good reason; 
  2. have good reason to believe that the Notice went to the wrong address; or 
  3. believe that the city cited the wrong person, business or property, 
You may file a written Motion to Set-Aside a Default Judgment with the Department of Administrative Hearings. In general, your Motion must be filed within 21 days of the mailing date stamped on top of the default judgment order. Motions are not granted automatically. You must file your motion on time and you must provide good reason why you did not respond to the Notice of Violation.  A motion form may be obtained from and filed in person Monday through Friday, 9:00 a.m. to 4:00 p.m. at the Main Information Desk, 400 West Superior Street location only.

What is an Administrative Law Judge?

Administrative Law Judge (“ALJ”):
This is the person who conducts an Administrative Hearing. They decide whether a municipal code violation has occurred and, if so, what penalty should be imposed. The City of Chicago, Department of Administrative Hearings contracts with approximately 74 Administrative Law Judges to conduct hearings. REMINDER about door and window screens

On July 18, 2014, after incidents this summer in which young children were severely injured or killed after falling from an open window, the Department of Buildings and the Department of Public Health are reminding residential building owners, occupants and parents to install operable window guards on windows and limit window openings to 4 inches or less.

The Chicago Building Code requires every door opening and every window to have screens in place from April 15th to November 15th of each year. Specifically, every door opening directly from any family unit to the outdoors and every window, or other outside openings used for ventilation purposes, must be supplied with a screen of not less than 16 mesh per inch and every screen door shall have a self-closing device in good working condition.

In 2014, as of July 18, 2014, the Department of Buildings issued 168 violations related to screens in windows.  Further information can be found on the City of Chicago website. If you own property in Chicago, make sure you keep current with the maintenance of your property. Owners are required by law to make necessary repairs and maintain their property in a safe condition. Environmental Permits & Regulation

The City of Chicago Department of Public Health's Environmental Permitting and Inspection Program aims to protect public health and the environment by reducing environmental risks throughout the city.  Staff in this program respond to citizen complaints, inspect sites and facilities, and enforce the environmental ordinances in the Chicago Municipal Code.

This program also includes a comprehensive permitting section.  Approximately 8,000 permits are issued each year for operations and activities that have an impact on the environment.  For example, permits are issued for work involving above ground and underground storage tanks, recycling facilities, waste handling facilities, construction site rock crushers, sandblasting, grinding, chemical washing, and the installation and operation of any equipment that has the potential to create or control air pollution.

Home Owner Assistance Permit

Did you know that the City of Chicago offers assistance in regards to permits for homeowners? The Home Owner Assistance permit process allows the owner occupant of a single family home to prepare the architectural drawings for a home alteration or addition with the assistance of a Department of Buildings Project Manager. No architect is required.

The Project Manager will perform the zoning review and assist in the preparation of a simple set of code compliant permit drawings.  Complex zoning issues, however, may require a Zoning Ordinance Administration review in Room 905 of City Hall.  The Home Owner Assistance process typically requires 3 to 5 one hour meetings with the Project Manager at any of  their three Neighborhood Residential Permit Centers.  The owner occupant must personally attend and participate in all meetings.

If you are caught without a permit, you may receive a costly Building Code Violation. The City of Chicago can also review your buildings past history and cite you for something that happened 10 years ago in which you did not obtain a permit.

Life Safety and High Rise Buildings

The City of Chicago’s High Rise Sprinkler and Life Safety Evaluation (LSE) Ordinances better protect the lives of residents, employees and visitors. The purpose is to demonstrate that a specific high-rise building can provide a reasonable level of safety from fire for the occupants. Safety Evaluations are intended to satisfy the Chicago Building Code  for an existing building exceeding 80 feet in height which does not have a full sprinkler system and is either occupied for non-transient residential uses or which is a landmark or other building so designated in accordance with the ordinance.

The Sprinkler Installation Ordinance (13-169-205) requires all pre-1975 commercial high rise buildings that are not land marked to install a full sprinkler system by January 1, 2017.  This ordinance also exempts existing pre-1975 non-transient, residential high rise buildings from the requirement to fully sprinkler the building.

The High Rise Life Safety Evaluation Ordinance (13-196-206) requires that the high-rise commercial buildings and residential buildings exempted from retro-fitting with sprinklers must undergo a rigorous evaluation of the building’s life and fire safety features from an Illinois Licensed Design Professional. The Design Professional must then submit a Life Safety Evaluation Report to the Department of Buildings and the Chicago Fire Department for their review and approval.  This report will score the Building in 18 categories of Life and Fire Safety and must contain all certified life safety upgrades required for the building to obtain a passing score.

Meeting the requirements of the Life Safety Evaluation Ordinance is a multi-step process:
  1. The Design Professional selected by building ownership must inspect and evaluate the subject Building and submit the LSE report to the Department of Buildings and the Fire Department.
  2. The Department of Buildings and the Fire Department must approve and accept the building’s Life Safety Evaluation (LSE) Report.
  3. By December 31, 2014, all construction required to comply with the individualized Life Safety Evaluation (LSE) report must be completed and verified through inspection by the Department of Buildings and the Chicago Fire Department.  Building permits must be obtained for the installation of any recommended upgrades to your building’s life safety structures or systems.  The Department of Buildings has created a streamlined permit process for LSE related construction work.

Owners are required by law to make necessary repairs and maintain their property in a safe condition.
