Why does the City of Chicago keep sending me a notice when I do not own this property?

This is due to the fact that your name appeared as a result of a title search. Unfortunately you will need to prove that the property is no longer yours. Simply informing the court that you do not own the property is not sufficient. Most likely, you will need to file a motion to set aside the default to resolve the case in a hearing.  Bradford Miller Law can help you with this.

Bradford Miller Law, located in downtown Chicago has been assisting clients with Building Code Violation issues for several years. Give us a call so we can help you correct this problem.

Can I have another hearing if I was found previously liable?

No, this is a final order you cannot have another hearing. Once a final order is entered, the department of Administrative Hearings no longer has jurisdiction (the legal authority) to take any further action. Your case can be appealed to the Circuit Court of Cook county. Appeals must be filed within 35 days of the final order. We may be able to help you with this process. Contact our office for a free 15-minute consultation to see if an appeal is your best option.

Common Building Code Violations

Bradford Miller Law, located in downtown Chicago has been assisting clients with Building Code Violations for several years. Contact our office is you have been cited for ANY building code violation for a free 15-minute consultation.

Avoid violations and make your house safer by fixing these common code violations:
  • Smoke Alarms should be placed on each level of the house and outside or in each bedroom.
  • Bathroom exhaust fans should vent to the outside. This can be either through the roof or the side of the house, not into the attic. Venting into the attic can cause rotting of the roof framing and sheathing.
  • Handrails without returns. Handrails need to turn and end at the wall. Returns keep items such as sleeves and straps from getting caught which can cause a fall.

Building Code Violation Hearings and Court

When you are cited for a Building Code Violation in Cook County you will receive a complaint and summons. The complaint lists the violations and the summons lists the time and date of the Administrative Hearing and or the first Court appearance. Bradford Miller Law can help you through this process.

City of Chicago and County of Cook Department of Administrative Hearings are generally heard at the Central Hearing Facility located at 400 W. Superior Street, Chicago, IL 60654. These hearings are for general routine cases.

The Housing Section of the Circuit Court of Cook County is located at the Richard J. Daley Center at 50 W. Washington Street, Chicago, IL 60602. The Housing Section hears cases involving municipal housing code violations dealing with all structures including residential, commercial, industrial, and institutional in Chicago and unincorporated Cook County. These cases are serious matters where the City of Chicago is legally filing suit. In addition to code violations, the Housing Section also hears appeals from the City of Chicago and the County of Cook Department of Administrative Hearings along with vacant building foreclosure cases filed by banks and lien holders.

Bradford Miller Law can help you prepare a response to the complaint and guide you from a legal standpoint as a Building Code Violation attorney. It is important that you send us all the paperwork as soon as possible so we can get started on your case.

Do you own a vacant lot?

Did you know that the City of Chicago sends crews out every year to clean up thousands of vacant lots. The city recoups their cost in part by ticket issuance and administrative hearing follow-ups with owners of these neglected properties.
The Vacant Lot Cleaning Program clears the lots of weeds and dangerous debris. Don't neglect your property. Periodically check your lot to make sure it is clean and free of debris. Failure to do so will eventually result in a citation.
Bradford Miller Law has been representing property owners and management companies for several years. Contact our office if you have been cited for ANY building code violation.

Guidelines to help you avoid receiving a Sanitation Code Violation

The City of Chicago has general sanitation guidelines that require the cleanliness and safe disposal of all trash and debris. Residential garbage is defined as what is produced from a household in single-family home or apartment buildings of four units or less. Some general guidelines for residents and businesses are as follows:
  • You must have sufficient containers to hold all garbage and lids  must be tightly closed on garbage containers. Raw garbage must never sit outside of the container.
  • Bulk pick-up must be arranged with the Streets and sanitation ward superintendent before placing a large item or extra load of trash out for collection. This includes discarded refrigerators and freezers. Please note the doors must always be removed before placing these items out for collection.
  • You are responsible for removing discarded building materials if you are remodeling. Dumpsters can be rented for this purpose.
  • If you own an apartment building you must provide sufficient garbage containers for all your tenants. You must also arrange for private or licensed scavenger pick-up service.
  • If you own a vacant and unimproved lot you are responsible for the upkeep. Litter, debris and abandoned vehicles must be removed from the property. Weeds cannot be allowed to grow more than 10 inches tall.
In addition to the above, businesses must also abide to the following:
  • Cardboard boxes must be broken down before leaving them outside for collection.
  • Arrangements must be made for the garbage to be removed by a licensed scavenger service.
  • Usage of City containers for restaurant or food garbage must be avoided.
  • Use and maintain a clean grease box.
The complete Municipal Code, Article II of Title 7 (Health and Safety), Chapter 7-28 which addresses this issue can be viewed online on the City of Chicago's website.

Contact our office if you have been cited for ANY building code violation. We have been representing property owners and management companies for several years.

I dont know what to do with this property....

I received a call last week from a man who was cited by the City of Chicago for a variety of violations.  He told me that he had enough, he did not want to deal with this property anymore.  He was not making any money and now he had to deal with all of these violations.

After a free phone consultation, we decided it was best if he sold the property.  He owed approx. $135,000 on his mortgage but the property was only worth about $110,000.  He did not have the money to make up the difference.  We decided the best option was to do a short sale.  A short sale will allow him to sell the home with the bank taking the loss.

To learn more about short sales, call my office for a free consultation.  My office charges no legal fees for homeowners seeking a short sale.

Call us today!

Why did the City cite me for building code violations?

Many people are cited for building code violations every day by the City of Chicago.  In many cases, I believe a neighbor or a tenant calls 311 to report a possible violation.  The City then sends out an inspector to determine whether any violations exist.  I also believe the City Inspectors  go up and down alleys to look at porches, decks, and other violations.

The City is broke and is looking for revenue.  If you have been cited with a violation, call my office right away.  We offer a free consultation and can represent you in Court and negotiate a deal with the City Attorneys.
